trademark laws. The owner of the copyrights and trademarks are CFP, its affiliates or other third party
licensors. YOU MAY NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST,
TRANSMIT, OR DISTRIBUTE, IN ANY MANNER, THE MATERIAL ON CFP, INCLUDING
TEXT, GRAPHICS, CODE AND/OR SOFTWARE. You may print and download portions of
material from the different areas of CFP solely for your own non-commercial use
provided that you agree not to change or delete any copyright or
proprietary notices from the materials. You agree to grant to
CFP a non-exclusive, royalty-free, worldwide,
perpetual license, with the right to sub-license, to reproduce, distribute,
transmit, create derivative works of, publicly display and publicly perform any
materials and other information (including, without limitation, ideas contained

areas of CFP (such as bulletin boards, forums and newsgroups) or by e-mail

connection with the submitted materials and other information as well
as in connection with all advertising, marketing and promotional
material related thereto. You agree that you shall have no recourse
against CFP for any alleged or actual infringement or misappropriation
of any proprietary right in your communications to CFP. Publications, products, content or services referenced herein or on
CFP are the exclusive trademarks or service-marks of CFP.
Other product and company names mentioned in CFP may be the trademarks of
their respective owners.

Images/Photographs.
All graphic images/photos
presented at CFP are recognized by the webmaster as
free material or images/photos owned by the member posting. If an
image contains another site's URL or copyright we do not use it
without written authorization. If you are the owner of an
image/photo in question, please inform us immediately at
admin@cutefamilypets.com.
It will either be removed or a link to the author's website will be
added, at the copyright owner's preference.

clearly identified as being supplied by CFP. CFP does not

discussed by the owners in our UBB.x forum. You are advised to

non-expert, non-professional opinions expressed by our UBB.x forum
members). CFP
may, from time to time, feature a new pet in various sections of CFP. Since we
cannot research every photograph
emailed to us, it is the sole responsibility of the
person submitting the photographs/images to ensure that
they have the necessary authorizations and/or permissions to use them.
CFP claims no ownership to any
photographs/imges received via email and they
are the sole property of the creator/copyright owner. In submitting them, you fully agree that you
shall indemnify and hold CFP harmless and
shall assume all liabilities that occur should a claim be
brought against CFP for their use.
4. Indemnification.
You agree to indemnify, defend and hold harmless CFP,
its officers, directors, employees, agents, licensors, suppliers and any third
party information providers to the Service from and against all losses,
expenses, damages and costs, including reasonable attorneys' fees, resulting
from any violation of this Agreement (including negligent or wrongful conduct)
by you or any other person accessing the Service.
5.
Personal Information.
There are times when CFP may need to gather
specific information from you such as your name, email address,
among other personal information. Information that is essential for
CFP
to carry out its function is generally designated as
"Required". Additional information that may be used for
internal statistical studies or market research is generally
indicated as "Optional". The choice of how much personally
identifiable information you disclose to CFP is
completely at your discretion. It is never mandatory for you to
answer any question, although it may mean that CFP
can't carry out certain functions as a result.
6. Third Party Rights.
The provisions of paragraphs 3 (Use of the Service), and 4 (Indemnification) are
for the benefit of CFP and its
officers, directors, employees, agents, licensors, suppliers, and any third
party information providers to the Service. Each of these individuals or
entities shall have the right to assert and enforce those provisions directly
against you on its own behalf.
7.Term; Termination.
This Agreement may be terminated by either party without notice at any time for
any reason. The provisions of paragraphs 1 (Copyright, Licenses and Idea
Submissions), 3 (Use of the Service), 4 (Indemnification), 6 (Third Party
Rights) and 8 (Miscellaneous) shall survive any termination of this Agreement.
8.Miscellaneous.
This Agreement shall all be governed and construed in accordance with the laws
of The United States of America applicable to agreements made and to be
performed in The United States of America. You agree that any legal action or
proceeding between CFP and you for
any purpose concerning this Agreement or the parties' obligations hereunder
shall be brought exclusively in a federal or state court of competent
jurisdiction sitting in The United States of America . Any cause of action or
claim you may have with respect to the Service must be commenced within one (1)
year after the claim or cause of action arises or such claim or cause of action
is barred. CFP's failure to insist
upon or enforce strict performance of any provision of this Agreement shall not
be construed as a waiver of any provision or right. Neither the course of
conduct between the parties nor trade practice shall act to modify any provision
of this Agreement. CFP may assign
its rights and duties under this Agreement to any party at any time without
notice to you. CFP reserves the right to monitor, and disclose to, government officials or law
enforcement, without your consent, any communications and personally
identifiable information, whenever prompted to do so by legal authorities, even
when you have requested that your information not be disclosed to third parties. Any rights not expressly granted herein are reserved.
